Qualia Recordings License

Introduction

Qualia Recordings is a music production and distribution company established to produce, promote and distribute the music of its Directors. Consequently, the copyright for the music hosted on the QualiaRecordings website is owned by the composers and Directors of QualiaRecordings.

The composers of each track on the Qualia Recordings website are recorded in the ID3 tags of each mp3 file and this information is also registered with the Australian Performing Rights Association (APRA). The "mechanical rights" for the recordings website are owned by Qualia Recordings.

We were interested in employing a Creative Commons (CC) "Some Rights Reserved" license for our music, but a suitable CC license (consistent with Australian Intellectual Property law) has not yet been developed. In these circumstances, we have developed our own license which is in some ways similar to the CC license. We certainly agree with the "Open Content" philosophy implicit in the CC approach and have no interest in attempting to limit "fair use" of our music by those who download it. We believe that the more people who hear our music the better and would only consider mounting legal action in circumstances where someone was violating our copyright by, for example, claiming attribution or attempting to profit from it.

We believe that most people appreciate that artists need to be appropriately rewarded for their endeavours. We won't object if you like our tracks so much that you share them with your friends, but we do ask that if you do this, please also help us by telling your friends about our website and suggesting that more great music can found there.

The License

This licence is non-exclusive. QualiaRecordings retains the right to grant licenses to other parties.

This license does not provide any right to the licensee to sub-license to other parties. This means that Qualia Recordings and the composers are the only providers of licenses for music produced and distributed by Qualia Recordings.

If Qualia Recordings music is reproduced, it must be reproduced in its entirety. Any attempt to adapt or alter the music without the express permission of Qualia Recordings, is not permitted. If you have a proposal for an adaptation of our music or a derivative work, please contact us we may be able to provide a special license for this and assist in other ways.

If the music is reproduced, each reproduction must include appropriate copyright notice. This is embedded in the mp3 files ID3 tags and refers to this web page. Any attempt to alter this information will be regarded as a violation of our copyright.

Qualia Recordings, however, reserves the right to prevent the republication of the music if this is deemed by Qualia Recordings to be detrimental to our business objectives. If you propose republishing our music on a website or in other media please contact us to negotiate this. Generally, we would not object to the republication of tracks which we provide for free download from our site (as long as it is correctly attributed), but would object to the free republication of tracks which are not free on the Qualia Recordings website as this would undermine our business model. We would also always insist on a link to the Qualia Recordings website.

Within the limits of applicable law, the copyright-owner provides the object as-is, and without warranty.
